Instead of defaulting to the light site theme, the site could detect the user system setting (for new and not-logged in users) and apply the dark or light based on that.

It’s not relevant for existing users.

Would'nt that need some sort of permission from the user beforehand to access the data?
I dont know about anybody else but if go on a new site and it asks of me permission for anything i usually decline it.

No, it doesn't need permission to detect this.
